OVERVIEW
Welcome to Dani Steel Hair.
DSTEEL STUDIO CORP, trading as Dani Steel Hair (“DANI STEEL”, “we”, “us” or “our”), operates this store and website, including all related information, content, features, tools, products and services offered through it (collectively, the “Services”).
Our online store is powered by Shopify, which provides the commerce infrastructure that enables us to offer the Services to you.
These Terms of Service (“Terms”), together with the policies referenced herein, govern your access to and use of the Services and describe your rights and responsibilities when purchasing from DANI STEEL.
Please read these Terms carefully. They contain important information regarding orders, payments, shipping, returns, warranties, limitations of liability and other legal rights.
By accessing, browsing, interacting with or purchasing through the Services, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, you should not use the Services.
Nothing in these Terms limits any mandatory consumer-protection rights that cannot legally be waived or restricted.
SECTION 1 — ACCESS AND ACCOUNT
By using the Services, you represent that you are at least the age of majority in your state, province, territory or country of residence, or that you have the legal authority required to use the Services.
When placing an order or using certain features, you may be required to provide information including your name, email address, telephone number, billing address, shipping address and payment information.
You agree that all information you provide is accurate, current and complete.
If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for activity conducted through your account.
You may not sell, transfer, assign or otherwise provide your account to another person without our authorization.
SECTION 2 — OUR PRODUCTS
DANI STEEL sells premium human hair extensions and related hair-extension products.
We make reasonable efforts to display product characteristics, shades, textures, lengths, weights and other specifications accurately.
However, colors and visual appearance may vary slightly depending on lighting conditions, photography, screen calibration, device settings and other display characteristics.
Human hair is a natural material. Minor variations that do not materially change the product specification may occur.
These natural or display-related variations do not affect your rights if the merchandise received is materially different from what you ordered, defective, damaged or otherwise non-conforming.
Product descriptions, specifications and availability may be updated when reasonably necessary.
We reserve the right to discontinue a product or limit quantities available for purchase, subject to applicable law.
SECTION 3 — ORDERS
Submitting an order constitutes an offer to purchase the selected merchandise.
An order is accepted when DANI STEEL confirms acceptance and the applicable payment has been successfully authorized or processed.
We may decline or cancel an order where reasonably necessary, including in cases involving suspected fraud, payment failure, pricing or inventory errors, legal restrictions, unavailable products or inability to fulfill the order.
If we cancel an order after payment has been collected, amounts due to you will be refunded to the original payment method.
Please review your product selections carefully before submitting an order.
Hair extensions may be prepared according to the shade, length, texture, coverage, weight and quantity selected by you. Because order preparation may begin shortly after acceptance, cancellation may not always be possible once fulfillment has started, except where required by applicable law.
Returns, replacements and refunds are governed by our Returns and Refunds Policy.
Purchases by beauty professionals for legitimate professional use are permitted.
Products may not be purchased for unauthorized resale, redistribution, fraudulent activity or export in violation of applicable law.
SECTION 4 — PRICES, PAYMENT AND BILLING
The price charged for a product is the price displayed and confirmed during checkout at the time the order is placed, subject to correction of obvious errors as permitted by applicable law.
Applicable shipping charges, duties, taxes and other amounts payable for an order are disclosed in accordance with our Shipping Policy and during checkout before payment is submitted.
Where an order is shipped DDP — Delivered Duty Paid, applicable import duties and taxes are prepaid as described in our Shipping Policy.
We currently charge the shipping amount stated in our Shipping Policy and displayed at checkout.
Prices, promotions and discounts may change from time to time. Changes do not affect previously accepted orders except where required to correct an obvious error or by applicable law.
You agree to provide accurate and complete billing and payment information.
Payments may be processed by Shopify and third-party payment providers made available during checkout.
By submitting a payment method, you represent that you are authorized to use that payment method and authorize the applicable payment provider to process the transaction.
We do not guarantee that every payment method will be available in every country or for every transaction.
SECTION 5 — SHIPPING AND DELIVERY
Shipping, fulfillment, handling times, transit times, tracking, shipping charges, duties and taxes are governed by our Shipping Policy.
Orders are prepared and dispatched from our fulfillment partner in China and shipped to the delivery address provided at checkout using DHL Express, as described in our Shipping Policy.
Our currently stated preparation period is up to 15 business days, followed by the applicable DHL Express transit period stated in the Shipping Policy.
Delivery dates may be affected by circumstances outside our reasonable control, including carrier disruptions, customs procedures, severe weather, transportation interruptions and force majeure events.
If an order is lost, damaged in transit, delivered incorrectly or otherwise affected by a shipping issue for which DANI STEEL or the carrier is responsible, we will handle the matter in accordance with our Shipping Policy and Returns and Refunds Policy.
Tracking information is provided after dispatch in accordance with our Shipping Policy.
You are responsible for providing a complete and accurate delivery address.
Nothing in this section limits any mandatory rights available under applicable law.
SECTION 6 — RETURNS, REPLACEMENTS AND REFUNDS
Returns, replacements and refunds are governed by our Returns and Refunds Policy.
The corporate address listed in these Terms is provided for legal and contact purposes and is not, by itself, an authorized merchandise return address. Returns must follow the return instructions provided by DANI STEEL under the Returns and Refunds Policy.
DANI STEEL does not generally accept returns solely because of a change of mind involving shade, length, texture, coverage, weight or quantity selected by the customer, except where applicable law provides a mandatory right of withdrawal or return.
Incorrect, damaged, defective or materially non-conforming merchandise is handled separately and is not treated as a change-of-mind return.
Customers should inspect their order promptly after delivery and follow the procedures and timeframes stated in the Returns and Refunds Policy.
Hair should not be installed, worn, washed, cut, colored, chemically treated or otherwise altered before submitting a claim involving an apparent problem, unless the alleged defect could not reasonably have been identified before use or applicable law provides otherwise.
Approved refunds are issued according to the method and timeframe stated in the Returns and Refunds Policy.
Mandatory consumer rights always prevail where applicable.
SECTION 7 — INTELLECTUAL PROPERTY
The Services and their content, including trademarks, trade names, logos, text, graphics, photographs, product imagery, videos, designs, page layouts, product descriptions and other materials, are owned by or licensed to DANI STEEL or its applicable licensors and are protected by intellectual-property laws.
You may use the Services only for lawful personal or legitimate professional purposes.
Except as expressly permitted, you may not reproduce, distribute, modify, republish, commercially exploit or create derivative works from our protected content without prior written authorization.
“Dani Steel”, “DANI STEEL”, Dani Steel Hair and associated branding, product names, method names, designs and slogans may constitute trademarks or proprietary brand assets.
Shopify and other third-party trademarks belong to their respective owners.
No provision in these Terms grants ownership or a license to intellectual property except where expressly stated.
SECTION 8 — THIRD-PARTY SERVICES AND TOOLS
Certain features of the Services may depend on third-party providers, including Shopify, payment processors, shipping carriers, analytics providers and other technology or service partners.
These providers may operate under their own terms and privacy policies.
Where third-party functionality is offered through our Services, availability may depend on that provider.
Nothing in this section eliminates DANI STEEL's responsibilities as the seller of merchandise purchased directly from our store.
SECTION 9 — THIRD-PARTY LINKS
The Services may contain links to websites, platforms or services operated by third parties.
We are not responsible for the content, security, availability, policies or practices of websites that we do not operate or control.
You should review the terms and privacy policies of third-party services before providing information or entering into transactions with them.
The presence of a link does not necessarily constitute endorsement.
SECTION 10 — RELATIONSHIP WITH SHOPIFY
Dani Steel Hair is powered by Shopify, which provides technology and commerce infrastructure supporting the Services.
However, purchases made through our store are transactions directly between you and DSTEEL STUDIO CORP trading as Dani Steel Hair.
DSTEEL STUDIO CORP is the merchant responsible for the merchandise sold through our store, subject to these Terms and applicable law.
Shopify is not the seller of DANI STEEL products.
SECTION 11 — PRIVACY
Personal information collected through the Services is processed in accordance with our Privacy Policy.
Because our commerce infrastructure is powered by Shopify, Shopify and certain third-party service providers may also collect and process information required to provide checkout, payments, security, analytics and related services.
Please review our Privacy Policy for further information regarding personal data, privacy rights, data sharing, cookies and international data transfers.
SECTION 12 — REVIEWS, FEEDBACK AND USER CONTENT
If you voluntarily submit reviews, photographs, comments, suggestions or other feedback (“Feedback”), you represent that you have the necessary rights to provide that content.
You grant DANI STEEL a worldwide, non-exclusive, royalty-free license to use, reproduce, display, adapt and publish Feedback for legitimate business and promotional purposes, subject to applicable privacy and advertising laws.
You must not submit Feedback that is knowingly false, misleading, unlawful, defamatory, infringing or fraudulent.
Where compensation or another incentive was provided in connection with a review, disclosure requirements under applicable law must be followed.
DANI STEEL may moderate or remove content that violates these Terms or applicable law.
SECTION 13 — ERRORS, INACCURACIES AND OMISSIONS
We make reasonable efforts to maintain accurate product, pricing, shipping, availability and other commercial information.
Occasionally, typographical errors, technical errors, inaccuracies or omissions may occur.
Where legally permitted, we may correct an error and notify affected customers.
If an error materially affects an accepted order and the order cannot reasonably be fulfilled as represented, we may cancel the affected order and refund amounts paid.
Nothing in this section permits DANI STEEL to disregard mandatory consumer rights or intentionally misrepresent merchandise, pricing or commercial terms.
SECTION 14 — PROHIBITED USES
You may use the Services only for lawful purposes.
You may not use the Services to:
- violate applicable laws or regulations;
- commit fraud or submit false information;
- infringe intellectual-property, privacy or other legal rights;
- introduce malicious software or interfere with website security;
- impersonate another person or organization;
- attempt unauthorized access to systems or accounts;
- scrape, copy or extract protected content for unauthorized commercial exploitation;
- interfere with the normal operation of the Services;
- use payment methods without authorization;
- submit fraudulent orders, chargebacks or claims;
- harass, threaten or abuse other users or our personnel.
Legitimate search-engine indexing and automated access expressly authorized by us or permitted through our technical settings are not prohibited by this section.
We may restrict or terminate access where reasonably necessary to protect our customers, business, systems or legal rights.
SECTION 15 — SUSPENSION AND TERMINATION
We may suspend or terminate access to the Services where reasonably necessary, including for fraud, security threats, unlawful activity, material violations of these Terms or abuse of our Services.
Termination does not eliminate obligations or rights that arose before termination.
Provisions that by their nature should survive termination will remain effective, including provisions concerning intellectual property, liability, dispute resolution and outstanding payment obligations.
SECTION 16 — PRODUCT WARRANTIES AND LEGAL RIGHTS
Nothing in these Terms excludes warranties, remedies or consumer protections that cannot legally be excluded.
To the extent permitted by law, digital and website functionality may be provided on an “as available” basis and may occasionally be interrupted.
This does not affect DANI STEEL's obligations regarding merchandise that is defective, damaged, incorrect or materially non-conforming.
Product remedies are determined by our Returns and Refunds Policy and applicable law.
SECTION 17 — LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, DANI STEEL will not be liable for indirect, incidental, special, punitive or consequential losses arising from use of the Services where such liability may legally be excluded.
Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by law.
Nothing in this section limits mandatory consumer remedies relating to defective, damaged, incorrect or materially non-conforming merchandise.
Third-party service interruptions, carrier delays or events beyond our reasonable control will be handled in accordance with these Terms, our policies and applicable law.
SECTION 18 — INDEMNIFICATION
To the extent permitted by law, you agree to indemnify and hold harmless DSTEEL STUDIO CORP and its directors, officers, employees, contractors and service providers from third-party claims arising from your unlawful use of the Services, material breach of these Terms or infringement of another party's rights.
This provision does not apply where prohibited by consumer-protection law.
SECTION 19 — SEVERABILITY
If any provision of these Terms is determined to be invalid, unlawful or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed where necessary.
The remaining provisions will continue in effect.
SECTION 20 — WAIVER AND ENTIRE AGREEMENT
Failure by DANI STEEL to immediately exercise a right under these Terms does not constitute a waiver of that right.
These Terms, together with our Privacy Policy, Shipping Policy, Returns and Refunds Policy and any other applicable policies displayed through the Services, constitute the agreement governing use of the Services.
Where mandatory law provides greater consumer protection, that law prevails.
SECTION 21 — ASSIGNMENT
You may not assign rights or obligations under these Terms in a manner that materially interferes with our rights without prior written consent.
DANI STEEL may assign its rights and obligations in connection with a legitimate corporate restructuring, merger, acquisition or transfer of the business, subject to applicable law.
SECTION 22 — GOVERNING LAW
These Terms and any separate agreements through which we provide the Services are governed by the laws of the State of Florida and applicable federal law of the United States, without regard to conflict-of-law principles.
Subject to any mandatory consumer-protection rights or jurisdictional rights applicable where you reside, disputes relating to these Terms may be brought before the appropriate state or federal courts located in Florida.
Nothing in this section deprives a consumer of mandatory rights or remedies available under applicable law in their jurisdiction.
SECTION 23 — INTERNATIONAL CUSTOMERS
DANI STEEL may make products available to customers in multiple countries.
Availability, shipping methods, duties, taxes, statutory withdrawal rights and other mandatory consumer protections may differ depending on the destination.
Where applicable local law grants rights greater than those provided in these Terms or our policies, the mandatory local law prevails.
Countries currently available for purchase are those made available during checkout.
SECTION 24 — CHANGES TO THESE TERMS
We may update these Terms from time to time to reflect changes to our business, products, Services, technology, policies or applicable legal requirements.
The most current version will be published through our store.
Where required by applicable law, we will provide notice of material changes.
Changes will not retroactively eliminate rights already acquired under an accepted order.
